HTWHEREAS
1. R.K.K. Sports Management INC. owns and operates land known as “CE23 Academy” located at 1260 Kenmount Road, Paradise, Newfoundland and Labrador, A1L 1N3.
2. The Gymnasium may be used for the purposes in which it is intended, such as artistic, athletic, and fitness related activities.
3. The Releasor wishes to participate in the Activities.
IN CONSIDERATION OF CE23 Academy permitted the Releasor to participate in the Activities, I agree to the following terms and conditions of this agreement:
1. Confirmation of Physical Condition: The Releasor affirms that they are in good physical condition and does not suffer from any known disability or condition that would prevent or limit their participation in the Activities. The Releasor acknowledges that it is their sole responsible to determine whether the participation in the Activities is acceptable given the status of their health.
2. Release of Liability and Waiver of Claims: The Releasor expressly waives and releases any and all claims which they have or may in the future have against CE23 Academy, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors and assigns (the "Releasees"), on account of bodily injury, death or property damage arising out of or attributable to the Releasor’s participation in the Activities, due to any cause whatsoever, including without limitation the negligence of CE23 Academy or any other Releasee, breach of contract, or breach of any statutory or other duty of care owing under occupiers liability or otherwise. The Releasor covenants not to make or bring any such claim against CE23 Academy or any other Releasee, and forever releases and discharges CE23 Academy and all other Releasees from liability under such claims.
3. Acknowledgment and Assumption of Risk: The Releasor is aware of and understands that the Activities involve physical activities that carry risks, dangers, and hazards, including but not limited to the risk of bodily injury, death, or property damage. The Releasor acknowledges that they are voluntarily participating in the Activities and freely accepts and assumes all of the risks, dangers and hazards involved and the potential for bodily injury, death or property damage as a result of the Activities.
